Civil liability

Many may think that damages happened in their rental home will be taken over by their insurer because they got an insurance for their civil liability. This is a common mistake.

Comprehensive home insurance contract subscription will insure you for the two civil liabilities (sometimes for both, sometimes for one or another)

Private life civil liability

Article 1382 and following of French Civil code : will be covered, unintentional consecutive bodily injuries, material and immaterial damages that you may cause to people during your private life.

For example: you accidentally fall over someone and broke his glasses. Or you spill some wine on your neighbor in a restaurant. This insurance will be also available during a non-paid internship for studies (school, university).

But what will happen if you accidentally broke a lamp during your stay?

Private life civil liability provides to fix third-parties damages but lessor is not a third party as you are connected to him by the lease contract.

That damage won’t be covered by your private life civil liability.

How will it be indemnified? It could be by an « accidental damages » guarantee as we offer in FFI Travel Pack. If not, the cost will be deducted on your security deposit.

Civil liability as a tenant

Article 1732 and following of French Civil code: is covered, assumed liability, as a tenant, in case of fire, explosion or water damage happening in the rented home.

For example: you are using a bathtub and joints become porous. Water is flowing out and soaking the wall between your flat and your neighbor’s flat (this is very common). Or you are starting a fire while cooking and it is spreading in the building.

What will happen here if you accidentally broke a lamp ? It will be the same conclusion because only fire, explosion and water damage are covered by locative civil liability.

If insurance subscription is key, it is highly recommended to add well-suited guarantees.
